1. Who provides the service
TrackName is a domain-monitoring service. In these terms, “we”, “us” and “our” mean its legal operator, identified below. “You” means the person or organisation using the service. If you subscribe for an organisation, you must have authority to accept these terms for it.
These terms, the plan you select and any written order we agree with you form your subscription agreement. A written order takes precedence where it expressly changes these terms. Your mandatory consumer rights always apply.
2. What TrackName does
TrackName checks domain registration and expiry, published registration-record changes, website content and certificates, DNS records, and uptime and performance. It compares observations and sends alerts or reminders according to your plan, settings and the information available.
You can monitor public information about a domain without owning it. TrackName does not register, renew, reserve, purchase, sell or transfer domains. You remain responsible for renewals, registrar settings, website operation and any action you take after an alert.
An expiry date, status change or availability result does not guarantee that you will be able to register a domain. Registries may publish incomplete information, redact fields or update their records after a delay.
3. Your account
Provide accurate account and billing details, keep your sign-in credentials secure and tell us promptly if you suspect unauthorised access. You must be legally able to enter into this agreement. Creating an account does not, by itself, start a paid subscription or activate monitoring.
Only add alert recipients who have agreed to receive the messages or for whom you have another lawful basis. Keep those addresses current. You are responsible for the domains, checks and recipients you configure.
4. Plans and payments
Domain monitoring is charged in USD per domain, with your choice of billing period:
- Monthly: $5 per domain per month.
- Yearly: $50 per domain per year, paid annually.
Your subscription total is the selected number of domains multiplied by the rate for your chosen billing period. Each domain includes all five monitoring groups. Existing fixed-package subscriptions retain their agreed terms until changed.
Stripe Checkout shows the total payable, applicable taxes, billing period and renewal terms before you commit. Your bank may charge for currency conversion. No extra domains or paid add-ons are purchased automatically.
Subscriptions are paid in advance and renew monthly or yearly, as selected, until cancelled. Monitoring starts after payment is confirmed and your domain and required settings have been added. A payment confirmation alone does not configure your monitoring.
You can manage the subscribed domain count in billing. Stopping or removing a domain does not automatically reduce that count or your subscription charge. Reductions take effect at renewal; domains above the new allowance are paused and their history is retained.
If a payment fails, we may suspend paid checks after notifying you and giving you a reasonable opportunity to resolve it. We will explain any effect on monitoring. A plan change and any adjustment to charges must be shown to you before you accept it.
5. Cancellation and refunds
You may cancel renewal before your next billing date by contacting us. If a billing-management link is available in your account, you may also use it. Ordinary cancellation takes effect at the end of the paid billing period; access continues until then. Stopping a single check or removing a domain is not a cancellation of your subscription.
Unless your order states otherwise or the law requires a refund, ordinary cancellation does not refund an unused part of the current billing period. This does not limit remedies for a faulty service, an incorrect charge or a statutory withdrawal.
Consumers’ right to withdraw
If you are an EU or EEA consumer and statutory withdrawal rights apply, you normally have 14 days from concluding the service contract to withdraw without giving a reason. Send us a clear statement that you wish to withdraw, with your name, account email and order date. You may use the wording below, but do not have to.
I withdraw from my TrackName subscription contract, ordered on [date]. My name is [name], my address is [address] and my account email is [email]. Date: [date].
We will refund payments due following a valid withdrawal within 14 days of being informed, using the original payment method unless you agree otherwise, without a refund fee. If you expressly requested that service start during the withdrawal period, we may deduct a proportionate amount for service already provided, but only where the law permits and the required information was given. Starting a recurring subscription does not automatically remove your withdrawal right.
Consumers elsewhere retain the cancellation, refund and service-quality rights that apply in their country. Contact us about a withdrawal, billing mistake or service complaint.
6. Acceptable use
Use TrackName lawfully and respect the rights of domain holders, website operators and other people. Do not use the service to:
- harass people, send unsolicited messages or collect personal information for unlawful purposes;
- circumvent access controls, probe private systems or attempt unauthorised access;
- submit secrets or sensitive personal data in monitoring targets, page keywords or support messages when they are not needed;
- overload the service, bypass limits, interfere with checks or misuse another person’s account.
We may restrict a check or account where reasonably necessary to address abuse, a security incident or a legal obligation. Where possible, we will explain the reason and allow you to resolve the issue. Immediate restrictions may be necessary to protect others. You can contact us to dispute a restriction.
7. Content and personal data
You retain your rights in information you provide. You give us permission to use it to perform the checks you request, maintain your history and deliver the service. Public records, website text and screenshots may belong to third parties; monitoring them does not transfer their rights to you.
Our software, brand and original materials remain ours or our licensors’. Your subscription permits you to use the service for its intended purpose; it does not give you ownership of the software.
Our privacy policy explains how personal data is handled. If your organisation needs us to process personal data on its behalf, the required data-processing terms must be agreed before that processing begins.
8. Service limits
Checks run periodically. Their frequency varies by signal and plan. Changes between checks, source failures, rate limits, maintenance and delivery problems can delay or prevent a result or an alert. Missing data is not evidence that a domain is safe, available or unchanged.
Some checks depend on a supported public data source or an enabled probe region. We do not connect to registrar accounts or check private auto-renew settings. We will identify relevant coverage limits when you configure a domain. There is no guaranteed response time, continuous availability or service-level agreement unless we expressly agree one in writing.
Keep your registrar’s renewal notices and other operational safeguards in place. Check time-sensitive information with the relevant source before acting. TrackName provides observations and notifications; it does not prevent outages, domain loss or unauthorised changes.
9. Responsibility and liability
We will provide the service with reasonable care and skill. We are responsible for losses caused by our breach to the extent required by applicable law. We are not responsible for an independent registry’s or registrar’s decision, or a third-party outage that we did not cause, except where the law makes us responsible.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, deliberate misconduct, or death or personal injury caused by negligence. Nothing removes a consumer’s mandatory rights, including remedies where a digital service does not conform to the contract.
If we permanently discontinue paid service before the end of a period you have paid for, we will refund the unused portion unless you receive an equivalent remedy required by law.
10. Changes and disputes
We may update these terms or the service for legal, security or operational reasons. We will give reasonable advance notice of a material change, explain when it takes effect and allow you to cancel before a new price or materially different subscription term applies. A posted price change does not change a period you have already paid for.
Contact us first with a complaint so we can try to resolve it. Applicable law determines governing law and jurisdiction unless a valid written agreement specifies them. Consumers retain any mandatory protection and right to bring a claim in their home jurisdiction. These terms do not require consumer disputes to be resolved exclusively through arbitration.
